In the Arrested Development case, the argument would be that the TV show’s title is so similar to the band name that the public would be confused as to the source of the mark. Generally, the touchstone of a trademark infringement suit is the plaintiff’s ability to show a likelihood of confusion between the plaintiff’s mark and the defendant’s mark. There was also the band’s trademark infringement action against Fox over the television show Arrested Development. There was the 2005 appearance on Hit Me Baby One More Time, during which Arrested Development edged out the likes of CeCe Peniston (“Finally, it has happened me…”) and Tiffany (“I think we’re alone now…”) for top honors in the show’s competition of nostalgia. Nevertheless, aside from Speech’s solo projects, as well as a few “Best of” and let’s-remix-their-hits albums, we haven’t heard much from the Arrested Development camp.
